Before You Get Started

After you have decided to open a business you should first develop a working business plan. Although this may now seem unnecessary, it will provide you with a roadmap for success and it will be necessary should you ever seek financing. You can search the internet for various examples of a business plan; an excellent site for developing your plan is located at the US Small Business Administration website.

The first step is filing your new company name. Discussed earlier, your "doing business as..." statement must be provided to the public in print and it also must be filed with San Bernardino county. The Hi-Desert Star newspaper in Yucca Valley has the forms you will need to complete both requirements. They will run the DBA statement in the local paper and will file it with the county for you. You may, if you choose to, run your DBA statement in any authorized newspaper in San Bernardino County.

Next comes the bank. To open a business checking account the bank will require you to show proof that a DBA statement has been filed. Some will accept the initial filing paperwork while others may require you to have the county-endorsed statement with you.

Prior to selling or leasing any tangible property, other than your own personal property, you must first possess a California Resale Permit. There is no charge for the permit and it is easy to get. You should seek professional advice on legal matters such as copyrights and trademarks if you will be dealing with the property, to include intellectual propery, of others. Additionally you should seek professional advice on setting up your books. A Certified Public Accountant (CPA) can save you a great deal of time and headache in the long run. Not only does the CPA do your "books" but they can also act as a financial/business advisor.

Basic License Requirements:

The Town of Yucca Valley. There is a business registration program for the Town of Yucca Valley; and certain types of businesses do require a special license and/or permit to operate here. Please contact the Town of Yucca Valley for additional information at (760) 369-7207.

1. Home-Based Businesses. If you plan on operating a business out of your home you will be required to have a Home Occupation Permit issued by the Town of Yucca Valley. This permit ensures that the business does not adversely affect your neighbors.

2. Massage Services. No person shall practice massage as a massagist, employee or otherwise within the Town, unless that person has a valid massagist's permit issued by the Town.

3. Peddler's License. No solicitor, canvasser, peddler, hawker, transient merchant, itinerant merchant or itinerant vendor shall engage in such business within the Town without first obtaining a license.

The County of San Bernardino

1. Fictitious Name Filing. Information can be found at the San Bernardino County website.

2. Notification to Assessor. Businesses are required to notify the County Assessor's Office of new business activities. Additional information can be found at the San Bernardino County Assessor's website.

3. Weights and Measures. If your business will use scales, fuel pumps, electronic or manual price lookup scanner devices or measuring devices they must be calibrated and pass inspection by the Agricultural Commissioner's Office. The State of California

1. Company Filings. If you will operate a corporation, a Limited Liability Company (LLC) or a partnership you must file with the California Secretary of State. Additional information can be found at the Secretary of State's website.

2. Sales and Use Permit. If you will sell or lease tangible property you must possess a California Seller's Permit issued by the State Board of Equalization (BOE). Additional information can be found at the BOE website.

The Federal Government

If you will operate a partnership or a corporation or if you will hire employees you must obtain an Employer Identification Number from the I.R.S. You can download the required form (SS-4) from the IRS website.
